We are proud of our colleague Nancy Gutzler, who has been recognized as a foremost expert witness in complex liability and insurance coverage disputes. She was recently named a Global Elite Thought Leader by Who’s Who Legal in its 2021 list of Top Insurance and Reinsurance Expert Witnesses.

According to Who’s Who Legal, published by Law Business Research Limited, Global Elite Thought Leaders are “individuals who received the highest number of nominations from peers, corporate counsel and other market sources this year. Our research has identified them as truly outstanding practitioners and the very best in their field.”

Who’s Who Legal uses the recommendations of clients and private practitioners to select leading experts in a range of practice areas worldwide. Market commentators described Nancy as "a phenomenal expert" who is "very experienced and polished.”

Nancy has decades of experience providing financial and litigation support and expert testimony services to clients. She has expertise in mass torts, product liabilities, and environmental pollution and has consulted with clients on many issues related to the analysis of large volumes of claims.

Highlights of her work include: 

  • Assisting clients with analysis of claims data, sampling of claims populations, allocation of claims costs to insurance coverage, and development of claims processing procedures and systems.
  • Using proprietary technology and industry expertise to review and classify historic insurance coverage, reconcile and reconstruct historic claims data, forecast future liabilities, and allocate liabilities to insurance coverage.
  • Advising policyholders in settlement negotiations concerning a variety of coverage issues, including the impact of alternative trigger and scope theories, and assisting defendants in identifying and recovering from insolvent insurers.
  • Providing testimony in cases involving issues related to proof of underlying exhaustion, allocation of claims to insurance, implementation of cost-sharing agreements (including the Wellington Agreement), industry standards and procedures regarding the collection of documentation and capture of data related to settlement of mass tort claims, and calculation of interest on in-lieu-of payments and on unpaid insurance receivables.
  • Designing custom systems from scratch to meet customer specifications, building in automation, validation, and controls.
  • Frequently speaking at conferences including those by the American Bar Association and Perrin Conferences.
