Later this week, I will participate in panel discussions during Perrin’s Sexual Abuse Litigation and Coverage Conference on October 5, 2023, in New York City. I am also co-chairing the conference, and KCIC is a sponsor.

It’s a full day devoted to a difficult, but important, topic. It will begin with opening remarks from my fellow co-chairs and me: Tracey McDevitt Hagan of Reilly, McDevitt and Henrich, P.C. and Brian Kent of Laffey Bucci and Kent.

After the morning sessions, I will moderate a panel at 2:00 p.m. (local time) titled “Valuing Insurance Assets of Sexual Abuse Defendants.” The panel will consist of Alexis N. Dyschkant of Covington and Burling; Richard A. Janisch of Arcina Risk Group; Ben Mermelstein of HighRock Analytics; and Miranda Turner of Crowell and Moring.

We will tackle issues around connecting legal theories of sexual abuse liability to the quantitative valuation of insurance programs, as well as structuring coverage valuation models to isolate potential areas of dispute. We will also address coverage law and assumptions regarding occurrence definition, application of annual aggregates and allocation theory. Finally, we will discuss the nuances of bankrupt and solvent defendants.

KCIC is at the forefront of working with organizations that face sexual abuse claims. They take a horrific human toll and also raise a host of liability management and insurance issues. Financial compensation can never right the wrong, but it can be an important part of the healing process for survivors.
